Home based and food businesses

We acknowledge that home-based businesses contribute to the local economy and the fostering of a vibrant business community. In some circumstances, small-scale businesses can operate from home as a 'home activity' under the Development Act 1993 or, since 19 March 2021, the Planning, Development and Infrastructure Act 2016.

A home activity is not deemed development and does not require approval from Council, provided it is operated within certain guidelines, which are designed to protect the residential nature and quality of an area.

What is a 'Home Activity'?

A 'Home activity' means use of a site by a person/resident on the site;

  1. that does not detrimentally affect the amenity of the locality or any part of the locality; and
  2. that does not require or involve any of the following:
    • assistance by more than 1 person who is not a resident in the dwelling;
    • use (whether temporarily or permanently) of a floor area exceeding 30 square metres;
    • the imposition on the services provided by a public utility organisation of any demand or load greater than that which is ordinarily imposed by other users of the services in the locality;
    • the display of goods in a window or about the dwelling or its curtilage;
    • the use of a vehicle exceeding 3 tonne tare in weight.

An activity is considered to have a detrimental effect on the amenity of the locality if it:

  • creates repeated, prolonged or loud noise
  • increases traffic on the street with delivery vehicles or customer car parking
  • produces smoke, smells, fumes, dust, etc.
  • operates outside normal working hours.

Activities involving food

If you intend to establish a home business that involves the preparation, transportation or storage of food for sale, you will need to seek a separate approval from the Eastern Health Authority (EHA).

Visit the EHA website to find out more about food regulations, safety standards and necessary approvals.

Signage

If you conduct a business from your home, signage is permitted under certain conditions. Visit our business signage page to learn more.
